			<content:encoded><![CDATA[<p>In California, as in other states, a homeowner can declare a &#8220;Homestead&#8221; in their home to protect a statutory amount of equity from the claims of certain creditors. During times of distress in the real estate market, companies emerge to prey on misunderstanding surrounding the homestead law.</p>
<p>You do not need to pay for a Homestead Declaration. In fact, a homestead filing service is prohibited from charging more than $25 for a homestead. If a service does charge, they cannot collect a fee until the homestead is recorded.</p>
